The COGNAC GAUTIER online store is accessible at the following internet address: www.cognac-gautier.com.

Any order placed on the online store is subject to these General Terms and Conditions of Sale and implies their unreserved acceptance by the buyer, who acknowledges having read them when placing their order during the purchasing process.

The buyer pledges that they are over the age of eighteen on the date of the order.

In the event of the buyer’s non-compliance with these conditions, COGNAC GAUTIER reserves the right to cancel all or part of the orders in progress, or to suspend the delivery of goods. Any clauses and conditions contrary to these General Terms and Conditions of Sale appearing on purchase orders and more generally on any type of correspondence from the buyer shall be deemed unwritten and shall have no contractual value between the parties.

These General Terms and Conditions of Sale may only be waived with the express written agreement of COGNAC GAUTIER.

COGNAC GAUTIER reserves the right to correct any accidental material error or omission in these terms and conditions, as well as in any other contractual documents.

ORDERS

It is not possible to place any pre-orders..

Orders from buyers located outside mainland France (including Corsica) will not be accepted.

For all export sales, please contact our partner cognac stockist “ La Cognathèque ».

Orders will be confirmed – within the limit of available stock – by COGNAC GAUTIER in a confirmation email from the store* sent to the buyer within 1 to 3 working days.

COGNAC GAUTIER reserves the right to refuse any order for legitimate reasons. In particular, in cases where the quantities ordered, over one or more orders, are unusually high and

disproportionate to the usual quantities ordered by buyers in their capacity as non-professional consumers.

PRICE

Product prices are given in euros including VAT (€ incl. VAT), excluding delivery costs. The prices invoiced are those shown in the online store on the date the buyer’s order is placed.

COGNAC GAUTIER reserves the right to change the prices in effect in the online store at any time. Any price changes will be automatically applicable on the date the price change is published in the online store.

PAYMENT

The buyer must pay the price indicated in euros when placing their order on the online store by bank card(VPAY, VISA, Mastercard, Maestro, American Express) via the “Sumup” platform.

SHIPPING AND DELIVERY TERMS

Products ordered and paid for are shipped from Monday to Friday inclusive, except for public holidays, from the store* within one to four working days from the day on which the order confirmation e-mail is sent.

These deadlines may be extended during periods of increased activity or in the event of exceptional closures (Christmas & New Year, annual closure, inventory, etc.).

Deliveries can only be made to the address provided by the buyer.

DELIVERY COSTS

Delivery costs are included free of charge for product orders amounting to €150 incl. VAT or above.

For product orders below €150 including VAT, delivery costs are invoiced per recipient at a flat rate of €13 including VAT.

PRODUCT DEFECTS

In the event that one or more products in the order are defective, due to transport, the buyer may return said product(s) to COGNAC GAUTIER within 14 days of delivery. Return shipping costs shall be borne by COGNAC GAUTIER

In order to receive a product replacement, the buyer must return the product(s) in the original packaging to the following address:

COGNAC GAUTIER undertakes to exchange the buyer’s product(s) as soon as possible.

BUYER’S RIGHT OF WITHDRAWAL & REFUND

The buyer has a period of 14 days from delivery to exercise its right of withdrawal.

The buyer must then notify its decision by filling out the following form and sending it to the email address (cognacgautier.accueil@mbws.com)

To receive a refund, the buyer must return this form by post with the contents of the order (in their original packaging) within 14 days from the day after delivery, to the following address: Maison COGNAC GAUTIER – 28 Rue des Ponts – 16140 Aigre.

Return postage fees shall be borne by the buyer.

The refund will be made within 14 days of notification of the buyer’s withdrawal, or at the latest on the day the returned products are collected, via the payment method used by the buyer when placing the order.

PRODUCT GUARANTEES

The products sold materially correspond to the characteristics presented to the buyer in the Online Store, when they are used in strict compliance with the purposes for which they were sold. Unless otherwise provided by law, COGNAC GAUTIER’s liability shall under no circumstances exceed the value of the invoiced goods.

ACCESSING THE ONLINE STORE

COGNAC GAUTIER reserves the right to make changes to the online store and the website www.cognac-gautier.com, at any time and without prior notice.

COGNAC GAUTIER therefore declines all liability in the event of interruption to or inaccessibility of the online store. The same applies in the event of malfunction or loss resulting from fraudulent acts committed by a third party.

COGNAC GAUTIER is released from its obligations by the occurrence of events constituting force majeure or fortuitous events.
